Terms of Service

1. Acceptance of Terms
By accessing or using Character Art at characterart.com (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Character Art ("we", "us").
2. The Service
Character Art lets you generate images and videos with artificial intelligence from text prompts and images you upload, and to edit, upscale, and animate those creations. AI output is probabilistic: we do not guarantee any particular result, quality, or suitability for a given purpose, and generated content may occasionally be inaccurate or unexpected.
3. Accounts
Creating art requires signing in with a Google account. You are responsible for activity on your account. You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. We may suspend or terminate accounts that violate these Terms.
4. Credits, Subscriptions, and Payments
Creations consume credits. Subscription credits are granted each billing cycle, do not roll over, and are set to the plan's allowance at each renewal; they expire when the subscription ends. One-time credit packs do not expire. Credits have no cash value and are non-transferable. Payments are processed by Stripe; subscriptions renew automatically until canceled via the billing portal. Except where required by law, purchases are non-refundable, including credits spent on generations you are unsatisfied with. Blocked requests (see Section 8) are not charged.
5. Your Content and Inputs
You may provide text prompts and upload images ("Inputs"). You retain ownership of your Inputs and represent that you have all rights needed to provide them — including, for photos of people, any consent required. Photos you upload as inputs are processed transiently to create your artwork or video and are not retained by us.
6. Intellectual Property Rights
For any images and videos you generate using our services, you retain full ownership to the maximum extent permitted by law. However, there are a few caveats:
- Your ownership rights are limited by the terms of this Agreement.
- The rights of any third parties may also affect your ownership.
AI outputs may occasionally be similar to other users' outputs; we cannot guarantee uniqueness. For a more comprehensive understanding of intellectual property laws in your specific location, we recommend seeking advice from a qualified attorney.
7. License Grant to Character Art
By using the Service, you grant to Character Art, its successors, and assigns a perpetual, worldwide, non-exclusive, sublicensable, no-charge, royalty-free, irrevocable copyright license to use, copy, reproduce, process, adapt, modify, publish, transmit, prepare derivative works of, publicly display, publicly perform, sublicense, and/or distribute any content you submit, create, or make available through the Service — including without limitation the text and image prompts you input into the Service; images, videos, and any other output produced by the Service at your direction; and your profile information, including your username, display name, profile picture, bio, and any links you add — regardless of whether a creation's visibility is public or private. This section does not give us any right to retain, publish, or distribute the photos you upload as inputs beyond what is described in Your Content and Inputs above; those uploads are processed transiently and are not retained by us. For clarity, changing a creation's visibility from public to private does not revoke or limit the license granted under this section with respect to that creation or any content associated with it. The license granted to Character Art remains in effect even after termination of this Agreement by any party, for any reason.
8. Acceptable Use and Moderation
You may not use the Service to create content that is illegal, sexually explicit, exploits or endangers minors, promotes violence or hatred, harasses real people, or infringes others' rights; or to attempt to circumvent safety systems. Prompts and uploads are screened by automated moderation, and requests may be blocked before generation (blocked requests cost no credits). We may remove content and restrict accounts that violate this section.
9. Community Content
The gallery contains user-generated content. We do not endorse it and are not responsible for it. If you believe content infringes your rights, contact us at the address below and we will review it promptly.
10. Disclaimers and Limitation of Liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
11. Changes
We may update these Terms; material changes will be reflected on this page with an updated date. Continued use after changes constitutes acceptance.
